If you haven’t been following the case, Jeff Koons tried to sue a company for making balloon dog book ends. The judge in the case just threw down some pretty hardcore lol’s on Koons, making him look like a complete douche bag.
Highlights:“As virtually any clown can attest, no one owns the idea of making a balloon dog, and the shape created by twisting a balloon into a dog-like form is part of the public domain.”and
“Upon information and belief, Jeff Koons LLC purports to represent the intellectual property rights of Jeff Koons, a retired stock broker whose sculptures and other works are well-known for copying pre-existing forms and images from popular culture.”
DARUSHIMO ADDS: also a funny suit considering Koons was sued in 1992 for making a ceramic reproduction of another artist’s photo. His defense was that his nearly identical sculpture was a parody and legally allowed under “fair use.” The court found that the piece parodied a general type of art, and not the particular photo, so the ‘fair use’ exemption didn’t apply. Koons lost the case.
